Impaired driver- arrest
On February 20, 2013, at 10:28 a.m., Guelph police observed an electric motor assisted bicycle northbound on Stevenson Street North. This bicycle struck a curb causing the driver to fall from the bike. Police conducted a traffic stop at this time to assist the driver. While police assisted the driver, grounds were formed that he was intoxicated.
Further investigation discovered that this particular electric bicycle had the dual ability to be operated under muscular power or under the power of an electric motor. However, the pedals had been removed and the bike was being operated only by the electric motor. The driver who was not injured was arrested.
William BEAVER, 47 years of Guelph has been charged with impaired driving and failure to provide a breath sample. He will appear in court on March 5, 2013.
Police wish to remind the public when riding an electric motorized bicycle, if the pedals are not attached to the ebike, or are not being used, the ebike is then classified as a motor vehicle under the Criminal Code of Canada. An ebike with the pedals attached and being used properly falls under the definition of a bicycle under the Highway Traffic Act.
