Reminder - Distracted Driving

Three offences:
Drive- display screen visible to driver, section 78(1)HTA
Drive-hand-held communication device, section 78.1(1)HTA
Drive-hand-held entertainment device, section 78.1(2)HTA

The set fine amount for these offences was increased from $125 to $225, effective on March 18, 2014. As a result, the total amount payable upon conviction for a distracted driving offence will be $280 ($225 plus $50 victim fine surcharge and $5 court costs).

Remember, the actual offence is not just the usage of the devices; you can be fined for holding the device while driving, whether you are texting or talking on it or whether it is on or off does not matter.

To use your device in a motor vehicle, all of the following conditions must be met:
1. The motor vehicle must be off the roadway or lawfully parked on the roadway.

2. The motor vehicle is not in motion.

3. The motor vehicle is not impeding traffic.

Tips use blue tooth, use a dash mount holder for your device or best of all do not use a device at all. Stay focused and drive safe.
